reply to public consultation on report SOU 2017:45 New Trade Secrets Act

IT&Telecom companies have been offered the opportunity to respond to the consultation. The report considers how Directive (EU) 2016/943 of the European Parliament and of the Council on the protection of undisclosed know-how and business information (trade secrets) against unlawful acquisition, use and disclosure should be implemented in Swedish law. The report also contains considerations on how an increased criminal liability for those who attack trade secrets can be designed.

IT&Telecom companies support the Confederation of Swedish Enterprise's proposal for a consultation response and are generally positive to the proposals in the report.

The IT and telecoms industry is driven by high levels of innovation and new technologies, with many companies using trade secrets to protect their innovations, making common legislation at EU level particularly important.
