These General Terms and Conditions are intended to apply to projects in which the parties’ project methodology and forms of collaboration are based on agile principles and in which the requirements for what the supplier is to deliver to the customer are defined incrementally.
These general provisions are not intended for use in projects with a predefined requirements specification, but rather when requirements are developed incrementally throughout the project, based on a project objective. The project requires that the parties be able to quickly adapt to new circumstances that arise during the project’s implementation. The project is managed by the parties jointly taking responsibility for the planning, implementation, and monitoring of the step-by-step work in order to achieve the Project Objective. The success of the project depends largely on the parties’ ability to collaborate and manage the project. The Supplier’s obligations to fulfill the Project Objective are set forth in Sections 3.3.1 and 3.3.2. The parties may agree on specific pricing models for the project’s implementation. The Supplier’s assignment may constitute only a part of the Customer’s overall project.
These General Provisions constitute an appendix to the agreement entered into by the parties. In the event of any conflict in the Agreement, the sections of the Agreement drafted by the parties shall take precedence over these General Provisions. In the event of any conflict between the Statement of Work and the Project Plan, the Project Plan shall take precedence over the Statement of Work.
