Industry awaits PTS' position on data retention
On Friday, Sten Heckscher presented his quick analysis of the consequences of the European Court of Justice's annulment of the Data Retention Directive for Sweden.
He believes that the Swedish data retention obligation meets the basic requirements of EU law. However, Heckscher's investigation has not changed the operators' minds. The industry is now awaiting PTS's position. PTS has previously announced that the authority will not enforce the obligation for the time being. I can therefore conclude that it is still unclear to the industry what applies. On Tuesday next week, I will be attending a hearing in the Committee on Justice and Home Affairs, together with representatives from PTS, Säpo and others, where these issues will be discussed.
Updated at 15.00: PTS announced today in a letter to the operators who have been in contact with the authority on the issue that PTS will now assume that the Swedish rules on data storage will be applied.
