Background checks are becoming an increasingly common part of the recruitment process, but where exactly is the line between what is and isn't permitted? Legislation sets clear requirements for how checks may be carried out, not least through the General Data Protection Regulation (GDPR) and labor law principles. How do we ensure safe and quality-assured recruitment without exceeding the legal framework? During this meeting with People in Tech, we will discuss background checks from an employer and labor law perspective. The focus will be on practical challenges, boundaries, and how we can create legally secure and effective recruitment processes.
Among other things, we will discuss:
- When are background checks objectively justified, and how do we determine what is proportionate in different roles?
- How do we comply with GDPR when handling personal data in the recruitment process?
- What applies to questions about criminality and handling of extracts from the criminal record?
- How and when should consent be used in a recruitment situation – and when is it inappropriate?
The aim of the meeting is to share experiences, highlight legal frameworks, and discuss how we can work with background checks in a way that is both legally sustainable and practical.
