Compulsory redundancy objection against Unionen and Sveriges Ingenjörer's notice
As a result of the strike notice given on the issue of flex pensions, Almega Tjänsteförbunden, Medieföretagen and IT&Telekomföretagen have submitted objections to the counterparties Unionen and Sveriges Ingenjörer.
- Our counterparts have explained that it is only through an agreement on additional contributions to the ITP that the announced industrial action can be avoided. However, in the companies where the ITP plan applies, there is a duty to take industrial action on pension issues. "According to section 41 of the MBL, employees who are bound by a collective agreement may not take or participate in industrial action if it contravenes a provision on the obligation to maintain peace in a collective agreement, or if the action is aimed at amending the agreement," says Jonas Stenmo, General Counsel at Almega.
If Unionen and Sveriges Ingenjörer, despite this peace obligation objection, nevertheless take the announced industrial action, Almega will claim damages and/or take other legal action.
