General Data Protection Regulation (GDPR): How to get it right with IT&Telecom's new standard contract

Together with our member companies, we have developed new standard contractual clauses for the processing of personal data. The new contractual texts are specific provisions that are intended to be used in conjunction with our existing standard contracts when suppliers store or otherwise process personal data on behalf of customers (controllers).

With the entry into force of the General Data Protection Regulation (GDPR) on May 25, 2018, our new standard contractual clauses (special provisions for the processing of personal data) will replace the general clauses for the processing of personal data.

In order to comply with the requirements of the new Regulation, contracts already concluded should be renegotiated, for example by attaching the new specific provisions on the processing of personal data to the contracts concluded.

In our web shop there are now three versions of the so-called special provisions for the processing of personal data: one for Cloud Services, one for IT Infrastructure Services and one for other services (e.g. IT Projects, IT Services and Agile Projects). Therefore, please select the specific rules for the processing of personal data that are most appropriate for the service(s)/assignment(s)/maintenance in question.

The special provisions for the processing of personal data are accompanied by the annex Specification of the processing of personal data. The annex/form must be filled in by the customer and the supplier at the latest in connection with the conclusion of the contract.
