IT&Telecom members prevented from participating in public procurement

The Swedish Association of Local Authorities and Regions (SKL), together with SKL Kommentus and Inera, has developed a template for a so-called personal data assistant agreement that they believe should be used as a mandatory requirement in public procurement. The members of the IT&Telecom companies believe that the proposal will prevent them from participating in public procurement.

Limitation of liability

During the work on developing the template, IT&Telecom companies have met the working group within SKL on a number of occasions and submitted their views. What IT&Telecom companies mainly highlighted as problematic for the industry is the issue of limitation of liability.

Companies miss out on interesting business opportunities

Requiring unlimited damages, as in SKL Kommentus and Inera's proposal, will lead to fewer companies from the industry now participating in public procurement. This fear is also confirmed by Region Skåne, among others. In a report in Upphandling 24, Louise Strand, purchasing director at Region Skåne, says: "We are concerned about this development. Many companies have an image of public procurement as complicated and complicated and thus miss interesting business opportunities.

As a trade organization, IT&Telekomföretagen has received indications from our member companies that they will not be able to participate in procurements if the agreement developed by SKL is applied.

SKL must now clearly take on board what we have expressed and use the personal data assistant agreement template accordingly, while making it clear that the industry does not support the template that has now been developed.
